PARTICIPANT LIABILITY WAIVER AND RELEASE OF CLAIMS

Mountain Challenge – October 2, 2026

I, the participant, acknowledge that my participation in the Mountain Challenge at Pilot Mountain State Park is voluntary and involves inherent risks, including but not limited to physical exertion, dehydration, falls, collisions with natural or man-made objects, exposure to weather conditions, and other unforeseen hazards. I understand that participating in this endurance event may result in injury, illness, permanent disability, or death.

In consideration of being permitted to participate in the Mountain Challenge, I hereby expressly assume all risks associated with my participation in this event. I acknowledge that I am solely responsible for my own safety and well-being during the event and that I have consulted with a physician regarding any health concerns prior to participation.

I, on behalf of myself, my heirs, assigns, personal representatives, and next of kin, hereby release, waive, discharge, and covenant not to sue the event organizers, sponsors, volunteers, affiliates, Pilot Mountain State Park, the State of North Carolina, and all other individuals and entities associated with the event (collectively referred to as the "Released Parties") from any and all claims, liabilities, demands, actions, or causes of action arising out of or in connection with my participation in the event, including but not limited to those arising from negligence or any other fault of the Released Parties or any third party and/or participant.

I further agree to indemnify and hold harmless the Released Parties from any claims, costs, damages, or expenses (including attorneys’ fees) that may arise from my participation in the Mountain Challenge.

I certify that I am physically fit, have sufficiently trained for this event, and have not been advised by a medical professional against participation. I agree to abide by all event rules and regulations and to follow any instructions given by event officials.

By checking the box, I acknowledge that I have read and fully understand this Liability Waiver and Release of Claims. I voluntarily agree to its terms and understand that by signing, I am waiving substantial legal rights.
